Information required and why

As part of the process of us working together, I will need more information from you.

There are two steps to the process (both of which must be completed).

Step 1 ensures compliance with AML Laws.

Law firms in New Zealand are required to undertake certain background checks before providing services to clients or customers. This is to ensure compliance with the Anti-Money Laundering and Countering Financing of Terrorism Act 2019, the Foreign Account Tax Compliance (FATCA) and Common Reporting Standards (CRS) (“AML Laws”).

I will need to obtain and verify certain information from you. This information includes:

  • your full name; and
  • your date of birth; and
  • your residential address.

I am required to verify this information (using ID and proof of address).

An online ID check, known as Electronic Identity Verification (EIV), replaces the need to sight and collect copies of physical ID documents.

I outsource EIV checks to a company called RealAML.

To enable this, I require your consent to electronically verify your identity or perform any other associated customer due diligence which I may be required to complete.

At some stage, you will receive a text message asking you to verify your identity and address. Simply, follow the steps in the text message.

If you have a Company or Trust, I will need more information about the Company or Trust including the people associated with it (such as Directors and Shareholders, Trustees and Beneficiaries). You will receive an email or text message from RealAML asking you for more information about the Company or Trust and individuals associated with it. The text will have Emma Stanley Law branding, so you can be comfortable it is legitimate.

I may also need to ask you for further information about the nature and purpose of the proposed work you are asking me to do for you. Information confirming the source of funds for a transaction may also be necessary to meet legal requirements.

Step 2:

Not only this, but Land Information New Zealand sets out specific guidelines to verify identity.

I will require a certified copy of:

  • Your ID
  • Address
  • A document with your name (or the entity selling) and the address of the property being sold

You will need to provide PDF scans of certified copies of the original documentation.

If you are also using your Kiwisaver to assist with your home purchase, your Kiwisaver Provider will also require this information. Some providers have very specific requirements. Please make sure you read and follow these requirements. Your certified ID for your Kiwisaver withdrawal can also be used by me.
